LFLR 1. Applicability

Local Family Law Rule

Unless otherwise described herein, these rules shall apply to all family law proceedings including committed intimate relationships filed under RCW Title 26, except for Chapter 26.33. These rules also apply to civil protection order proceedings under RCW Title 7.105. Temporary civil protection order proceedings are also governed by LCR 40.1(b)(1)(C).

State court rules and other local court rules also apply to all family law and civil protection order proceedings.  Failure to follow these rules may result in the court imposing fines or penalties, including dismissal of the case.

Official Comment

RCW 26.12.010 confers authority upon Family Courts to hear any proceedings under Title 26 as well as any proceedings in which the court is asked to adjudicate or enforce the rights of the parties or their children regarding the determination or modification of parenting plans, child custody, visitation, or support, or the distribution of property or obligations. Family Law Commissioners are empowered to exercise all the powers and duties of court commissioners under the Washington State Constitution, Article IV, Sec 23, when operating under the authority of RCW 26.12.
