NOTICE OF PUBLIC HEARING

Proposed Ordinance 2025-0127

NOTICE IS HEREBY GIVEN, that a public hearing will be held before the Metropolitan King County Council on the 19th day of August, 2025, at 1:30 p.m. to consider adoption of Proposed Ordinance 2025-0127, an ordinance that would modify the County's school impact fee formula to account for varying dwelling unit size, to reflect updates to state law. The public hearing will be held at the King County Courthouse, 516 3rd Avenue, Room 1001, Seattle; remote public testimony on Zoom will also be accepted. Written public testimony will be accepted from 9 a.m. on July 18, 2025, through 10 a.m. on August 19, 2025, by sending such public testimony to clerk.council@kingcounty.gov. Please include the legislation number and related agenda item in the subject line. It is expected that the Council will take action on this Proposed Ordinance at the August 19, 2025, meeting following the public hearing.

SUMMARY:

The Proposed Ordinance would modify the County's formula for calculating school impact fees, by establishing six categories, each with different permit review process in multiple ways, including preapplication conference requirements, application submittal and screening requirements, notice of application, and timelines for final decisions.

FINAL ACTION:

Prior to final action, Councilmembers may offer amendments for consideration by the Council.  Persons wishing to testify on the Proposed Ordinance should attend the public hearing in person or remotely on August 19, 2025, or provide testimony in writing prior to the hearing.  Amendments that may be considered for adoption by the Council include, but are not necessarily limited to:

  • Modifying the six categories in the proposed ordinance to account for differences in square footage of dwelling units, either in addition to, or as a substitute for, number of bedrooms.
  • Modifying an existing exemption for affordable housing units from school impact fees to reduce the discretion the County has to review and approve them, in order to increase use of the exemption.
  • Establishing a maximum amount for school impact fees that a school district can charge.
  • Requiring analysis of the impact of school impact fees on housing production, as part of the report that accompanies school impact fee ordinances.
  • Any amendment offered, or relating to topics discussed, during the review of the subject legislation in committee.
  • Any matter preserved for consideration by the Council by a member during previous committee meetings.
